These Terms and Conditions (“Terms”) govern your use of 95andvine.com and any online features operated by 95 and Vine. By accessing or using the website, you agree to these Terms. If you do not agree, please do not use the website.
You must be at least 21 years old to purchase, receive, or consume alcoholic beverages or participate in alcohol-related offerings. By placing an alcohol order or arranging pickup, you represent that you are at least 21 and that the person picking up the order is at least 21.
Valid government-issued photo identification and a signature may be required at purchase, pickup, or service. We reserve the right to refuse or cancel an alcohol sale, pickup, or service when age or identity cannot be verified, when a customer appears intoxicated, or when required by law.
You may use the website only for lawful, personal, and noncommercial purposes. You may not:
Use the website in violation of any law or regulation;
Attempt to gain unauthorized access to the website, accounts, servers, or networks;
Interfere with website operation or security;
Introduce malicious code or use automated systems to scrape or overload the website; or
Copy, reproduce, distribute, or commercially exploit website content without permission.
Product descriptions, vintages, images, prices, menus, event details, hours, and availability may change without notice. We try to present accurate information but do not guarantee that all website content is complete, current, or error-free. Bottle labels and packaging may differ from website images.
We reserve the right to correct errors, limit quantities, substitute an item with your approval, reject or cancel an order, or discontinue an offering. Applicable taxes, fees, corkage, gratuities, or other charges will be disclosed when applicable. An order or reservation is not accepted until confirmed by us.
Orders offered through the website are available for pickup at the 95 and Vine store only. We do not offer local delivery or shipping through the website. Pickup availability, timing, minimum purchases, and other conditions may vary.
The person picking up an alcohol order must be present, at least 21 years old, and able to provide valid government-issued photo identification. The name on the identification may be required to match the name on the order or an authorized pickup person identified in advance. We may refuse to release an order when age or identity cannot be verified.
Wine-club benefits, selections, pricing, billing dates, pickup periods, and cancellation rules are governed by the wine-club terms provided at enrollment and may change upon reasonable notice. Members must be at least 21. By enrolling in an automatically renewing membership, you authorize recurring charges according to the disclosures presented at signup until the membership is canceled.
Unless different cancellation instructions are provided at enrollment, contact us at 95andvine@gmail.com or 386-947-7929 before the next billing date to request cancellation. Amounts already charged or selections already prepared may be nonrefundable except where required by law.
Reservations, ticketed events, tastings, and private rentals may be subject to deposits, minimum purchases, cancellation deadlines, guest limits, and other terms communicated during booking. A request submitted through the website is not a confirmed booking until accepted by 95 and Vine.
Guests must follow applicable laws and reasonable house rules. We may refuse service or remove a guest when necessary for safety, lawful alcohol service, or the comfort of others.
Returns and refunds are subject to applicable law and our then-current store policy. Because alcoholic beverages and event purchases may be regulated, perishable, time-sensitive, or specially ordered, some purchases may be final. Please contact us promptly if an item is damaged, incorrect, or otherwise defective so we can review the issue.
The website and its text, photographs, graphics, logos, design, and other content are owned by or licensed to 95 and Vine and are protected by intellectual-property laws. No rights are granted except the limited right to use the website under these Terms.
The website may contain links, embedded content, or functionality provided by third parties. We do not control and are not responsible for third-party websites, services, terms, privacy practices, availability, or content. Your use of a third-party service is governed by that provider’s terms.
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. Our total liability for a claim relating to the website will not exceed the amount you paid to 95 and Vine for the specific transaction giving rise to the claim or, if there was no transaction, $100.
Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
To the fullest extent permitted by law, you agree to indemnify and hold harmless 95 and Vine and its owners, employees, and agents from claims, damages, losses, liabilities, and expenses arising from your unlawful or unauthorized use of the website, your violation of these Terms, or your infringement of another person’s rights.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any legal proceeding relating to these Terms or the website must be brought in a court of competent jurisdiction located in Volusia County, Florida, unless applicable law requires otherwise.
